Макарова пришла к выводу что предмет деятельности компании — онлайн-обучение инвестиционной деятельности а не инвестиции. Компания оказывала клиентам образовательные и консультационные услуги онлайн продвигала образовательные услуги. Она согласно договорам учила клиентов как вкладывать средства. И средства граждан вносились за оказание консультационных услуг. Правовая природа договоров — возмездное оказание услуг — подчеркнула она. При этом есть некоторые пункты договора которые выходят за его пределы: это пункты о комиссионных членских взносах и прибыли. Так как компания иностранная вероятно есть законодательство той страны в которой она зарегистрирована которое предусматривает такие возможности. Возможно были какие-то партнерские договоры но эксперту они не были представлены. По договорам же которые представлены исполнитель говорит что предлагает стратегию и вы можете вложиться туда-то туда-то но клиент самостоятельно это делает. Предполагается что он обучил этого клиента — и давай теперь инвестируй сам. Если клиент попросит то исполнитель может объяснить и другие юридические действия по управлению активами или иные юридические действия может быть дополнительный договор по его запросу — но я не знаю были ли такие договоры — говорит Макарова. Вопрос процента нигде не указан исполнитель не гарантирует получение прибыли клиентом.
